Terms and Conditions

1. Use of the Website and the Service

You agree to use the website and the Service lawfully and not for any fraudulent or unauthorized purpose. You are responsible for the accounts you create, for keeping their sign-in secure, and for what is done under them. Each brand workspace (a "project") is managed by its administrators, who decide who else may access it.

2. Acceptable Use

You are responsible for what you create, upload and publish with the Service, including text, pages and pictures made with its AI features. You may not use the Service, or ask its AI features, to create or publish:

• sexually explicit, pornographic or otherwise NSFW content, and in any case no sexual content involving minors;
• content that depicts a real person without their consent, including in a sexual or misleading way;
• content that harasses or threatens anyone, or promotes violence or hatred;
• content that infringes the intellectual property or privacy of others;
• content that is unlawful, deceptive or meant to defraud.

We may refuse a request to the AI features, remove content that breaks these rules, and suspend or close the accounts and projects involved.

3. Plans and Limits

The Service is offered on a Free plan and on paid plans (Growth and Pro), as described on our pricing page. Each plan applies to one project and includes a capacity of customer profiles and the features listed for it. The Free plan is limited in customer profiles, live experiences, products and team members, and shows "Made with Jellybean" on published pages. When a project reaches a limit of its plan, what it already holds is kept, but it cannot add more until it moves to a plan that allows it. AI features are provided within a monthly usage allowance that depends on the plan.

4. Subscriptions and Payment

Paid plans are sold through a third-party payment provider, which processes the payment and may act as reseller and merchant of record for your purchase. Where it does, it collects any applicable tax and issues the invoice, and its buyer terms also apply to that purchase. The provider is named at checkout and on your receipt. Prices are shown in US dollars before tax.

A subscription renews automatically at the end of each monthly or annual period, at the price then in effect for its plan and capacity, until it is canceled. We tell you before an annual renewal. A move to a higher plan or capacity applies at once and is charged for the remainder of the current period; a move to a lower one applies at the next renewal.

You may cancel at any time before a renewal with Cancel renewal in the project's billing settings, or by emailing hello@jellybean.xyz. Paid features then remain available until the end of the period already paid for, after which the project returns to the Free plan. If a payment fails, the payment provider tries again; a subscription that cannot be paid may be canceled and the project returned to the Free plan. Refunds are governed by our Refund & Cancellation Policy.

5. Your Data and Your Customers' Data

You keep ownership of the content you upload and of the data your projects collect from your customers, which you may export. You are responsible for having the right to collect and use that data, and we process it on your behalf to provide the Service. When a project is deleted, it can be restored on request for 30 days, after which it is deleted for good, together with the data its customers gave to it. A customer's own Jellybean account, if they use it with other brands, is not deleted.

6. Intellectual Property

All content, including text, graphics, logos, and images, is the property of Bop Labs Inc. unless otherwise stated. Unauthorized use, reproduction, or distribution is prohibited without our written consent.

7. User Content

If you submit any content (e.g., comments, feedback), you grant us a non-exclusive, royalty-free license to use, modify, and display it.

8. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

9. Disclaimer

The website and the Service are provided "as is" without warranties of any kind. We do not guarantee the accuracy, reliability, or availability of the website, the Service or their content.

10. Limitation of Liability

To the fullest extent permitted by law, Bop Labs Inc. shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the website or the Service.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Canada.

12. Changes to Terms

We reserve the right to update these Terms and Conditions at any time, and we tell the administrators of paid projects before a change that affects their subscription takes effect. Continued use of the website or the Service after changes constitutes acceptance of the revised Terms.
